Re: Notice of Request for Relief and Dispute Resolution under the Florida Land Use and Environmental Dispute Resolution Act pursuant to Section 70.51, Florida Statutes, regarding approximately 464.74± acres located on the west side of Rye Road in Bradenton, (Manatee County), Florida.
The Request for Relief was filed on June 22, 2026 by Attorney Kyle Grimes, Grimes Galvano, P.A., representing Yort, LLC. and 2351 Rye Road, LLC, a Florida limited liability companies, (the “Petitioners”). The Request for Relief states that Yort, LLC. and 2351 Rye Road, LLC, are the fee simple owners of the real property. The Petitioners filed an application for approval of a rezone of 31.31 acres to PDR (Planned Development Residential) and a proposed preliminary site plan for 733 residential units on a total of 464.74 acres. The application was denied by the Board of County Commissioners on May 21, 2026, by the adoption of Resolution No. R-26-055. The subject real property is zoned PDR (Planned Development Residential) (433.32 acres) and General Agricultural (A) (31.31 acres) and is in the UF-3 (Urban Fringe- 3) Future Land Use designation.
Attached to this Notice is a copy of the Request for Relief with all exhibits.
The Special Magistrate will hold a public mediation in the dispute resolution proceeding as follows:

The process for citizens to participate in the dispute resolution session is detailed in the Manatee County Code, Part II, Article III, Sections 2-25-30 through 2-25-44. In order to qualify as participants before the Special Magistrate, persons are required to submit a written request to participate within twenty-one (21) days after receipt of this Notice of Filing with attached Request for Relief. The mediation and dispute resolution sessions being held before the Special Magistrate are pursuant to Section 70.51, Florida Statutes, and the process is detailed in the Manatee County Code, Part II, Article III, Sections 2-25-30 through 2-25-44. The hearing may be continued from time to time.

All interested parties may appear and be heard at the meeting with respect to the proposed Ordinances. According to Florida Statutes, Section 286.0105, any person desiring to appeal any decision made by the Board of County Commissioners with respect to any matter considered at said Public Hearing will need a record of the proceedings, and for such purposes, he may need to ensure that a verbatim record of the proceedings is made, which includes the testimony and evidence upon which the appeal is to be based.
Rules of procedure for Public Comment and Citizens’ Comments (including time limits) are governed by Resolution R-25-013, Restated Rules of Procedure (adopted 1/28/25).
