NOTICE OF LAND USE CHANGE

Official Actions Will Affect and Regulate Use of Real Property in Unincorporated Manatee County – Notice to Real Property Owners and General Public.

The Manatee County Board of County Commissioners will hold a public hearing to consider the adoption of the following amendments to the Manatee County Comprehensive Plan. The amendments pertain to the unincorporated area of Manatee County. At the conclusion of the public hearing the Board of County Commissioners shall determine whether to adopt, adopt with modifications or not adopt the amendments to the Manatee County Comprehensive Plan.

Additional amendments to the following may be necessary to implement

these changes and ensure internal consistency.


PA-25-02 / Ordinance No. 25-17 County-Initiated Comprehensive Plan Text Amendment

Repeal Of Ordinance 21-12 PLN2501-0167

An Ordinance of the Board of County Commissioners of Manatee County, Florida, regarding comprehensive planning, amending Manatee County Ordinance No. 89-01, as amended (the Manatee County Comprehensive Plan); providing a purpose and intent; providing findings to further the intent of the comprehensive plan to preserve land east of the Future Development Area Boundary(FDAB) for primarily agricultural uses and to contain urban sprawl; providing for a county-initiated text amendment to element 2, future land use, amending and restating policy 2.1.2.2, under objective 2.1.2, geographic extent of future development to delete an exception for eligible new development proposed for lands east of and coterminous and contiguous to the Future Development Area Boundary (FDAB) meeting specified criteria; deleting policy 2.1.2.8; amending policy 2.10.1.4 to delete reference to policy 2.1.2.8; amending element 9, public facilities, objective 9.2.1, concurrency, by deleting policy 9.2.1.5; amending objective 9.6.1, development requirements, policy 9.6.1.1 to delete reference to policy 2.1.2.8; providing for amendments as necessary to maintain internal consistency; repealing ordinances in conflict including, without limitation ordinance No. 21-12; providing for severability; and providing an effective date.

 

PA-25-01 / ORDINANCE No. 25-14 County-Initiated Comprehensive Plan Text Amendment Wetland Protection Reversion PLN2501-0039

An Ordinance of The Board of County Commissioners of Manatee County, Florida, regarding Comprehensive Planning, amending Manatee County Ordinance No. 89-01, as amended (The Manatee County Comprehensive Plan); providing a purpose and intent; providing findings; providing for a County-Initiated Text Amendment to Element 3-Conservation, amending and restating Goal 3.3, Objective 3.3.1, Wetlands Protection, Policy 3.3.1.1. to require an Impact Avoidance and Minimization Analysis to justify Wetland Impacts, acknowledging cases where no other practical alternatives exist to permit a reasonable use of the land or an overriding public benefit; Policy 3.3.1.2, requiring the delineation of the extent of wetland areas on a development site plan; Policy 3.3.1.3, requiring all development related impacts to wetlands be mitigated by complying with both the State of Florida Wetland Mitigation Standards and The County’s Mitigation Standards, Policy 3.3.1.5, providing for natural area buffers adjacent to all post-development wetlands and watercourses as stated in a Schedule of Minimum Buffer Widths; Policy 3.3.1.6, allowing for a variable width wetland buffer under limited circumstances; Policy 3.3.1.7, providing for the monitoring of Federal, State and Regional Dredge and Fill Permits; amending and restating Element 4-Coastal Management; Goal 1, Policy 4.1.2.5., providing for minimum buffer widths adjacent to environmentally sensitive coastal wetlands and discouraging the trimming of mangroves; providing for amendments as necessary to maintain internal consistency; repealing ordinances in conflict including Ordinance No. 23-66; providing for severability; and providing an effective date.

                                   

 

The proposed Ordinances are available for public inspection at the Manatee County Development Services Department, 1112 Manatee Avenue West, Suite 400, Bradenton, Florida, during regular business hours. A reasonable charge may be made for the provision of copies.

Interested parties may appear and be heard at the meeting with respect to the proposed Ordinance. The public hearing may be continued from time to time to a date and time certain or to no date certain and re-advertised. The Public may also provide written comments for the Board of County Commissioners to consider.

Rules of procedure for this public hearing are in effect pursuant to Resolution 25-013. A copy of this Resolution is available for review or purchase from the Development Services Department (see address below).
