Action Requested

Accept, execute and authorize recording of the Permanent Utilities Easement Agreement and the Temporary Construction Easement Agreement with Lake Flores I, LLC.

Enabling/Regulating Authority
Chapter 125, Florida Statutes.

Design Requirements approved as part of the General Development Plan for “Lake Flores” pursuant to Manatee County Zoning Ordinance PDMU-14-20(Z)(G).

Background Discussion
Construction of a new replacement force main is scheduled for this year.  The existing force main known as FM 1M currently runs within the north right-of-way of Cortez Road from a master lift station west of 86th Street to 66th Street, turns south to run along 66th Street to the Southwest Water Reclamation Facility (SWWRF).  During the project, the existing main must remain in service until the new main is constructed, tested and certified.  

But for this arrangement with Lake Flores, reconstruction of the existing line would require additional easements from  several property owners along Cortez Road West, to include the possibility of eminent domain proceedings.  Such an alternative would be both time consuming and expensive.

Public Works staff has coordinated with the Utilities Operations Division of the Utilities Department and representatives of Lake Flores to avoid development impacts and facilitate future connections in exchange for these easement donations.
