Adoption of Resolution R-19-138 approving a standard HIPAA Business Associate Agreement and authorizing the Director of Public Safety to execute the Agreements.
As the provider of Manatee County Public Safety, Business Associate Agreements (BAAs) are required in an instance in which the County hires a third-party vendor to perform activities, functions, or services that involve access to, use, or the creation of protected health information. Since BAAs are executed multiple times on an as-needed basis, Resolution R-19-138 delegates to the Director of Public Safety Department the limited authority to execute this form BAA without Board approval. Under this Resolution it will be the duty of the Department Director to provide an annual list to the Board documenting each time this form BAA has been executed.
HIPAA requires a healthcare provider ("Covered Entity") and any third-party vendor ("Business Associate") that performs services for, or on behalf of, a Covered Entity and has access to or creates a patient's protected health information in the performance of these services to enter into a Business Associate Agreement for the protection of the privacy and security of protected health information.
