Enabling/Regulating Authority

Florida Statutes, Chapter 336.09, et sec., Closing and Abandonment of Road, Authority, and 336.10, et sec., Publication of Notice

Manatee County Land Development Code, Section 331, Vacation of Streets and Plats

Background Discussion
  • The United States Army Corps of Engineers (USACOE) has requested the right to place dredge spoil from Port Manatee on this County-owned land.  Parks and Natural Resources Department staff intends to use the dredge spoil as fill material to recontour the property in furtherance of a project to restore Washington Park.  In order to proceed, the USACOE requires the County to first execute an instrument certifying certain matters regarding the Washington Park land.  Before the County can lawfully execute the instrument required by the USACOE, the County needs to close and abandon all the roads within the Washington Park parcel.  Accordingly, the Parks and Natural Resources Department wants the Board to close and abandon the roads within the Washington Park parcel.  The unimproved rights-of-way were dedicated to the public in 1914 but the area was not developed in accordance with the plat.  These rights-of-way are not part of the County's plan for future roadways.
  • Jurisdictional reviews by appropriate county departments serving the location to be vacated have been notified of the intention to file a vacation and have no objection.
  • The application complies with pertinent Florida Statutes and the Manatee County Land Development Code.
  • This is a County initiated vacation request; there is no application filing fee.
