Interlocal Agreements with the City of Bradenton and the Downtown Development Authority (DDA)

Authorization for the County Administrator to sign an Interlocal Agreement regarding Termination of Interlocal Agreement (Manatee County Administration Center Project) and Amendment of Interlocal Agreement Regarding Parking Facility by and between Manatee County, the City of Bradenton, and the Bradenton Downtown Development Authority.
Also, authorization for the County Administrator to sign an Interlocal Agreement regarding Operation and Maintenance of Administration Center Public Parking Facilities by and between Manatee County and the City of Bradenton.
Section 163.01, Florida Statutes
Manatee County, the City of Bradenton (COB), and the Bradenton Downtown Development Authority (DDA) entered into an Interlocal Agreement in 1987 to finance and construct the Manatee County Administration Center and parking garage. One of the major provisions in this agreement requires the DDA to make annual payments to the County towards payment on the debt service that was used to finance the Administration Center and parking garage.
Manatee County and the City of Bradenton also entered into an Interlocal Agreement in 2005 to provide the parking facility to serve the County's new Judicial Center in downtown Bradenton. One of the major provisions in this agreement is for the County to make annual payments to the COB towards costs of financing the Judicial Facility parking garage.
Payments on these two agreements have been expected to continue based on an ending date when the County's Administration Center bonds would expire in 2017. The Interlocal Agreement for the Administration Center has a provision that provides for a possible earlier termination date than the expiration of the bonds, but the language in the agreement is unclear on exactly how that date would be determined. Staff from the County and the COB have agreed on a proposed termination date of September 1, 2016, as provided in the Interlocal Agreement being considered today. As the Judicial Center Parking Interlocal Agreement contemplated the 2017 termination date for the Administration Center agreement, we would also amend that agreement to provide for a two year earlier end to the County payments to the City.
The effect of this is that the COB would not make a payment to the County of $1,204,049 for the current year and approximately the same amount next fiscal year. The County would not be required to make the last two payments to the COB of $625,000 in 2019 and 2020 as currently required in the Interlocal Agreement for the Judicial Center Parking Facility.
The FY 2017 Tentative County Budget reflects the changes proposed in the Interlocal Agreement being considered today.
Part of the original Interlocal Agreement for the Administration Center was a requirement for a portion of the garage to be used for public parking. Since the parking garage for the Administration Building was built, the COB has done the operations and enforcement for the public parking spaces in the garage. Also for consideration today is an Interlocal Agreement between the County and COB for the Operation and Maintenance of the 131 public parking spaces. These services will continue to be performed by the COB as they have done since the construction of the building. Term is for one year with the option for two additional two-year periods.
