Execute Contract for Sale and Purchase for a Permanent Easement totaling 353 square feet, owned by Randy L. Giddens, as trustee of the Randy L. Giddens Trust u/a dated 05/15/06, and Helaine A. Giddens, as trustee of the Helaine A. Giddens Trust u/a dated 05/15/06, each as to an undivided one-half interest as tenants in common.

Comprehensive Plan - Goal 11.5-11.7 addresses the potable water system.

Background Discussion
  • In 2008 Greyhawk Landing West constructed a 16 inch reclaimed water line that ran over their land and 117th Street East coming out at State Road 64.
  • Manatee County assumed maintenance responsibilities of this line in February 2012.
  • The subject reclaimed water line runs inadvertently over a small portion of land owned by Randy L. Giddens and Helaine A. Giddens near the intersection of 117th Street East and State Road 64 without an easement.
  • Negotiations between the property owner's attorney and Manatee County, including the County Attorney's Office, resulted in an all inclusive settlement of $5,000 which includes attorney's fees.
  • The quoted purchase price was a negotiated figure representing a litigation avoidance settlement which eliminates further costs for litigation including attorneys, property appraisers, land planners, engineers, and surveyors.
