I move to hold the second public hearing to adopt proposed Ordinance No. 16-31 on November 3, 2016 at 9:00 am or as soon thereafter as same may be heard, (in lieu of after 5:00pm) pursuant to Section 125.66(4)(b)1. Florida Statutes.
(NOTE: THIS MOTION REQUIRES AT LEAST 5 VOTES TO PASS).

• As part of the LDCT-16-06/Ordinance 16-31, staff is proposing to amend Table 4-7 - Schedule of Uses for PD Districts of the Land Development Code in order to allow Outdoor Storage (Principal Use) and Recreational Vehicle Parks and Subdivisions as “Permitted Uses” in the PDMU (Planned Development Mixed Use) Zoning District.
• Per Section 125.66(4)(b)1. Florida Statutes, in order to adopt changes to the actual list of permitted, conditional, or prohibited uses within a zoning category, the Board of County Commissioners shall hold two advertised public hearings on the proposed ordinance. At least one of the two required public hearings shall be held after 5:00 p.m. on a weekday, unless the Board of County Commissioners, by a majority plus one vote (5 votes in favor), elects to hold the second hearing at another time of the day.
• The proposed amendments to the LDC as describe above have been scheduled to go before the Plan Commission on September 8, 2016, and the first required public hearing before the Board of County Commissioners on October 6, 2016.
• Staff is requesting the Board of County Commissioners to hold the second required public hearing on November 3, 2016 during the regularly scheduled Land Use Meeting.
