Action Requested

Adoption of Ordinance 17-24

Based on recommended changes by staff to Land Development Code Chapter 11 (Impact Fees dated November 3, 2017) and Chapter 2 (Definitions related to impact fees dated September 18, 2017), the Management Action Plan from the Impact Fee of the public comments, the Board of County Commissioners adopts Ordinance No. 17-24.

Background Discussion
This is the second of two public hearings before the Board for this item. After the first public hearing with the Board on November 2, 2017, staff revised Chapter 11, reverting back to the original language specifying appeals of administrative decisions will be decided by the Board of County Commissioners.

In April and May, the Board of County Commissioners held work sessions on impact fees. The Board provided general direction to:
1) bring forward housekeeping updates to the Land Development Code (LDC) based upon the Clerk's audit, clarify policies and move administrative details to the proposed Impact Fee Procedures Manual;
2) allow the expenditure of "old money" within cities; and
3) bring forward item to allow consideration of County impact fees to continue at 90% of the schedule in the 2015 Impact Fee study instead of increasing to 100% in April 2018, amending the LDC.

This agenda is related to items #1 and #2 above, bringing forward housekeeping updates to the LDC based upon the the Management Action Plan from Impact Fee audits by the Clerk of the Circuit Court, clarification of policies and moving administrative details to the Impact Fee Procedures Manual. It also allows impact fees
collected before April 18, 2016 to be utilized in the incorporated areas of the county. On October 12, 2017, the Planning Commission found the LDC changes to be consistent with the
Comprehensive Plan and in accordance with the Land Development Code recommending approval of Ordinance 17-24.
