Action Requested

Motion to reduce the fines for case numbers CE2015110102, CE2015110114, and CE 2015110115 totaling $54,525.00, to be reduced to $1,000.00 (as previously recommended by the Special Magistrate on August 24, 2016), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amounts of $34,200.00 for case number CE2015110102, $7,050.00 for case number CE2015110114 and $13,275.00 for case number CE2015110115.
  2. Recording fees need to be collected, which total $100.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Per the applicant seeking relief, the property has been vacant since 2010, the pool was not maintained, mosquito's and black mold were in the air, and it was occupied by squatters and druggies. The current property owner (applicant who's parents live next door) purchased the property in July of 2016 for the sake of her parents health and the neighborhood. The applicant brought the property into compliance within twenty-five (25) days after purchase and has spent approximately $28,000 dollars in doing so.  Below is a brief synopsis regarding the case history:

  1. Violation:  Pool water and equipment not maintained, pool not secured with an effective barrier, fence in disrepair around pool, and roof leaking and collapsing.
  2. Notice of Violations issued 11/20/2015.
  3. Special Magistrate Hearing January 27, 2016.  Ordered all cases to comply by 2/19/2016 or a $75.00 per day fine would be imposed
  4. Complied: 
    1. CE2015110102 on 8/19/2016
    2. CE2015110114 on 5/24/2016
    3. CE2015110115 on 8/15/2016
  5. Fines for all three (3) cases total $54,525.00 plus $100.00 in recording fees.
  6. Property owner offered a total $1,000.00 plus the $100.00 recording fees to settle all three cases.
  7. Special Magistrate Mitigation hearing 8/24/2016. The Magistrate determined that justification exists to reduce the total fine amounts and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amounts totaling $54,525.00 to $1,000.00 plus $100.00 recording fees to settle all three cases.

Staff supports the recommendation to reduce the fine amounts.
