  • Renounce and Reject Temporary Utilities Easement from OK Willow Walk LLC recorded in Official Records Book 2726, Page 2889.

Background Discussion
  • Jessica Paz Mahoney ("Mahoney") is the attorney for the developer OK Willow Walk, LLC. Without requesting the assistance of Manatee County staff, Mahoney drafted and recorded three (3) Temporary Utilities Easements to Manatee County. Said Temporary Utilities Easements were never presented to the Board of County Commissioners for approval.
  • Said Temporary Utilities Easements contained errors in the legal descriptions and the easements are not of the appropriate duration (temporary as opposed to permanent).
  • The easements subject to this agenda coincide with Willow Walk Phase 2, Sub Phases A, B, and D.
  • A Permanent Utilities Easement, which has been reviewed by county staff and the county surveyor, will be presented to the Board of County Commissioners at a later date.
  • The County Attorney's Office (CAO) recommended that said Temporary Utilities Easements be specifically renounced and rejected.
