Motion to authorize the County Attorney's Office to initiate and to prosecute a lawsuit against S.L. Williams Consulting Corp. for damage to cable and conduit lines along 26th Street West between 55th Avenue West and 57th Avenue West, Bradenton, Manatee County, Florida.

On March 1, 2013, S.L. Williams Consulting Corp. was conducting digging operations along 26th Street West between 55th Avenue West and 57th Avenue West, Manatee County. The digging was pursuant to the Suburban Area Water Line Replacement Project Phase 2.
A fiber optic line, unrelated to the project, was damaged and connectivity lost during the afternoon of March 1, 2013. Manatee County's Information Technology Department directed another contractor, Mastec, to make the necessary repairs to the fiber network along 26th Street West, including the area where the damage occurred.
Mastec submitted invoice # 234159-15421 in the amount of $38,230.26 for the cost of repairs. This invoice has been paid by the County.
The County Attorney's Office believes that the evidence establishes that S.L. Williams Consulting Corp. negligently cut the fiber optic line. Risk Management has pursued a claim for damages with the contractor directly, its legal counsel, and its insurance carrier, with no resolution. Risk Management is requesting the Board recommend approval for the County Attorney's Office to file suit against S.L. Williams Consulting Corp. to recover the costs incurred by Manatee County in this matter.
