Stewart Grove Wastewater and Reclaim Water, Utility Participation Agreement

Action Requested
Authorization for the Chairman to execute the Utility Participation Agreement for Reclaim Water Line Construction and Wastewater Force Main with Neal Signature Homes, LLC.

Enabling/Regulating Authority

Policy of the Manatee County Comprehensive Plan authorizes the County to pay for the cost of additional materials necessary for oversizing any component of the potable water distribution system where a development is required to increase system capacity greater than that required by a proposed project.

Background Discussion

The Developer, Neal Signature Homes, LLC, is the owner of the property located in Manatee County, Florida, in Section 14, Township 34 South, Range 19 East.  The Developer has submitted to Manatee County a plan for a residential community on the property which is identified in PDR-13-43/14-S-08(P)/FSP-14-15, and which is known as "Stewart Grove" (the Project).

The Developer desires to connect the Project to the County's reclaimed water distribution system for the benefit of the Project, and as a result the developer will be constructing the reclaimed water line.

Furthermore, the Developer agrees to contribute a prorata share of the future costs of an offsite force main upgrade (the "Force Main Improvements") to be installed by Manatee County in the near future.

The Developer hereby agrees to install approximately 2,100 feet of 12-inch reclaimed water line including associated fittings and appurtenances within or adjacent to the Project (the "Utility Improvements").

The Developer and the County have reviewed the Estimate of Cost within the agreement and enter into this agreement with the understanding that such estimate is an accurate estimate of the costs of the Utility Improvements , as set forth in the agreement.

The County's obligation to reimburse the Developer shall not exceed the sum of forty-six thousand, six hundred and sixty-six and 00/100 dollars ($46,660.00) for the installation of 12-inch reclaim water line by the developer.

The Developer's obligation to the County shall be the sum of forty-six thousand, six hundred and fifty-five and 00/100 dollars ($46,655.00) for the future force main to be constructed by Manatee County. 

A Utility Participation Agreement is attached reflecting the agreed to participation by the County in a portion of the actual costs of the Utility Improvements.
