Background Discussion

Section 768.28, Florida Statutes, provides for a limited waiver of sovereign immunity for liability for torts, allowing the State (and its counties) to be exposed to money damages, up to the limits set in the statute.

Section 768.28, Florida Statutes, authorizes counties to be self-insured, to enter into risk management programs, to purchase liability insurance, or to have any combination thereof, in anticipation of any claim or judgment that counties may be liable to pay.  Based on that authority, since at least 1986, the Board of County Commissioners has had a self-insurance and risk management program.  The program was most recently revised by Ordinance 08-49, and is codified at sections 2-2-201 through 2-2-211 of the Manatee County Code.  The Risk Management Division is an operational arm of the County Attorney's Office (CAO).

This workshop is intended to accomplish two goals.  First, in light of staffing changes in Risk Management and some recent questions from Commissioners on how our self-insurance program works, the CAO will make a presentation to the Commission on the work of the Risk Management Division (RMD).

The second goal is to review with the Commission the attached proposed Ordinance 16-26, currently scheduled for a public hearing on October 25th.  The Ordinance makes a variety of recommended revisions to the current Self-Insurance Code and County Attorney Ordinance, including conforming the Code to the current operations of the RMD, increasing the settlement authority of the County Attorney by $10,000, and improving the organizational structure and clarity of the Code.
