Florida Power & Light Easement Agreement for Roadway and Sanitary Sewer Improvements - Willow Walk Phase II

Authorization for the Chairperson to execute the Florida Power and Light Easement Agreement with Manatee County Government for the Road Crossing at Willow Walk Phase II.
Florida Constitution Article III - Section 1e - Governing Powers
The developer is the owner of certain real property located in Manatee County, Florida, in Section 32, Township 33 South, Range 18 East and in section 5, Township 34 South, Range 18 East. The developer has submitted to the County a plan for a residential community on the property, which is identified as PDR-14-04(P)/17-S-18(P)/FSP-17-27, and which is known as "Willow Walk Phase II" (the Project). The developer desires to connect the project to Willow Walk Phase I's road network and sewer system for the benefit of the Project.
The proposed roadway between phases will cross the Florida Power and Light (FPL) Railroad Right-of-Way, and will benefit the developer and the Manatee County road network system. The attached FPL Railroad Easement Agreement for Willow Walk Phase II allows the connection of the roadway network and sanitary sewer between phases. The proposed roadway easement will become Manatee County's infrastructure and asset upon installation. Therefore, by executing this agreement, the County agrees to acquire the easement for the roadway improvements and acknowledges that the developer shall design, engineer, permit, and construct the roadway improvements within the easement in accordance with the approved site plan.
In general, all roadways and pipe crossings and/or accessing FPL or CSX Railroads Right-of-Way require a liability insurance policy in the amount of $3,000,000 with FPL shown as the Loss-Payee on the policy. The annual estimated premium for this policy is $1,400.00.
