Action Requested
  • Accept and Record Permanent Utilities Easement from Mandarin Development, Inc., and;
  • Record Affidavit of Ownership and Encumbrances from Peter Logan, as Vice-President for Mandarin Development, Inc. and;
  • Record Joinder and Consent from Braden River Mortgage LLC, a Florida limited liability company.

Enabling/Regulating Authority
  • Florida Statutes Chapter 125.  Manatee County Comprehensive Plan-Goal 9.1-9.2 addresses sanitary sewer, and Comprehensive Plan Goal 9.5 addresses the potable water system.

Background Discussion
  • The Applicant, Mandarin Development Inc. is requesting a vacation of a 600 square foot improved right-of-way at San Miguel Cove that is being presented simultaneously today.  This vacation is to eliminate an emergency inter-neighborhood connection between Riva Trace and Carriage Run Subdivision.
  • Subsequent to the approval of the 600 square foot right-of-way vacation, Mandarin Development Inc. will replace the vacated right-of-way with this Permanent Utilities Easement. 
  • The Permanent Utilities Easement addresses the concerns noted by the Public Works Department during the Jurisdictional review process for the vacation.
