Background Discussion

The Braden River Soccer Club, Inc., is a non-profit corporation which for years has provided organized soccer programs to the youth of Manatee County at Lakewood Ranch Park.

On February 7, 2012, the Board authorized the execution of a License Agreement for the club to construct, improve, and operate a permanent concession, storage, and restroom facility adjacent to the County-managed soccer fields located within the park in exchange for nominal yearly payments and adherence to a variety of operational and programmatic conditions.

Due to the Braden River Soccer Club's successful registration efforts, and in light of its desire to utilize additional fields for evening game play, the club has proposed to financially partner with the County to cause permanent lighting improvements to be installed on one additional field within the park for their immediate needs.

County staff, with approval of the attached amendment to the Braden River Soccer Club's current agreement, would agree to engage an appropriately-licensed and experienced contractor(s) to design and construct permanent lighting infrastructure for two currently unlit soccer fields and eventually four, paid for out of Park Impact Fees.  Lighting two fields at the current time will provide for a greater level of playability and for immediate practice overflow for several years.  Such lighting would be of the design and standards set by the County and would be professionally engineered and shielded so as to substantially reduce new light intrusion onto any residential lots abutting the newly-lit field.  The County would approve of the final lighting design prior to installation.  Once the lighting is installed and successfully inspected, all rights, title and ownership in the lighting would vest in the County.

The Braden River Soccer Club would agree to commit over three years a total of $45,000 toward the cost for lighting of one field; pay the electric charges for use of all field lights as provided in the agreement and the department's existing fee schedule; and agree that absent an exception granted by the Parks Director for unusual circumstances, play would end such that the soccer field lights would not be on later than 9:30 pm.

A public meeting will be scheduled with residents/representatives of the Rosedale subdivision to discuss lighting plans using state of the art LED lighting, and proposals highlighted in this agreement.

The Braden River Soccer Club also uses a non-permanent storage structure, placed on Lakewood Ranch Park property, as additional storage space.  The County has determined the structure requires certain structural and code improvements to ensure it is safe and attractive, and the club has offered to make such repairs and to maintain the structure to County standards and to complete such repairs within 90 days of the effective date of this agreement. Once all repairs and refurbishments required have been successfully completed, the club would execute any paperwork needed to memorialize the transfer of the structure and all rights, title and ownership would vest in the County. 

With exception of the above field lighting and non-permanent structure in the Amendment, and the leagues need for assurance of priority scheduling of Lakewood Ranch Park soccer fields #1-7, all other terms and conditions in the original February 2012 License Agreement, including but not limited to provisions concerning term, termination, default, remedies and program conditions, are and shall remain in effect, and shall govern the attached Amendment.

The Adopted FY 2016-2020 Capital Improvement Program (CIP) includes funding for this project from Parks Impact fees in FY 2017, Based on the need to move forward with this project to meet the increased levels of participation at the club, it is recommended that we move this project forward to the current fiscal year.  Resolution B-16-012 would appropriate $575,000 for purchase and installation of the field lighting based on the best available cost information, subject to cost obtained through a competitive bid.  $530,000 would come from Parks Impact Fees (which are available) and the remaining $45,000 is anticipated contribution from the league per the agreement.
