Action Requested
  • ADOPT Resolution R-18-054.  The adoption of this resolution is conditional and is subject to resolution of title issues, acceptable to Manatee County, prior to closing.
  • ADOPT Budget Resolution B-18-072 amending the Annual Budget for Manatee County, FL, for Fiscal Year 2017-2018.

Background Discussion
  • On March 20, 2018, the Board of County Commissioners approved the Assignment Option Agreement to assume the Conservation Foundation of the Gulf Coast, Inc. option agreement for the right to purchase the Myarra Property Joint Venture, LLC., property. 
  • The parcel is approximately 32.37 acres presently owned by Myarra Property Joint Venture, LLC ("MPJV") and the County wishes to acquire the "MPJV" property for the Braden River Preserve Project.  The cost to acquire this parcel is $3,000,000.00.
  • The Conservation Foundation of the Gulf Coast ("CFGC") has committed to transfer approximately an 11.6 acre parcel known as the "Bergstresser Estate Lot" adjacent to the "MPJV" property at no cost to the County creating a combined preserve area of approximately 44 acres.  The deed and conservation easement to this parcel will be held in escrow and conveyed to the County when the title has been cleared.
  • The "CFGC" shall contribute at least $1,029,645.00 as a donation to the County as a contribution for the purchase of the "MPJV" property.  The "CFGC" will make this donation directly and immediately to the County at or prior to the closing.  
  • The Cooperative Agreement regarding the Braden River Preserve with "CFGC" memorializes the obligations and responsibilities of the parties.
  • The Conservation Easements in favor of "CFGC" will be over both parcels, which is approximately 44 acres as agreed in the Cooperative Agreement.
  • All documents for this real estate transaction will be held in escrow until closing.  The expected closing will be on or before May 22, 2018, then all conveyance documents will be recorded in Official Records of Manatee County.  Currently there is a title issue that Myarra Property Joint Venture, LLC must resolve, subject to Manatee County acceptance, prior to the closing.
