Action Requested


Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Zoning Ordinance No. PDR-15-15(Z)(P); APPROVE the Preliminary Site Plan with Stipulations A.1-A.6, B.1-B.3, C.1, D.1–D.8, and E.1; GRANT Special Approval for a project: 1)  exceeding a gross density of one dwelling unit per acre in the UF-3 and MU-C/R Future Land Use Categories (FLUCs); 2) exceeding a net density of three dwelling units per acre in the UF-3 and MU-C/R FLUCs; and 3) adjacent to a perennial stream; as recommended by the Planning Commission.

Background Discussion

Ms. Katie LaBarr, Agent for Neal Communities of Southwest Florida, LLC, Empire State Holding Group, LLC, Anthony F. Fanto, Virgil Bryce Wager, as Trustee of the Lucy F. Wager Revocable Living Trust, and Schroeder Manatee Ranch, Inc. requests approval of a rezone of approximately 49.32 acres from the A (General Agriculture-One dwelling per five acres) to PDR (Planned Development Residential) zoning district on the east side of White Eagle Boulevard (Bradenton).
• The 49.32± acres will be added to an already rezoned 151.32± acres for a combined total of 200.64± acres.   The applicant requests approval of a new Preliminary Site Plan for an additional 137 lots for a total of 590 lots (a density of 2.94 dwelling units per acre) for single-family detached and semi-detached residences.   453 lots were approved [PDR-14-25(Z)(P)] on 2/5/2015.
• The site is in the UF-3 (Urban Fringe-three dwelling units per acre) and MU-C/R (Mixed Use- Community/Residential) Future Land Use Categories (FLUCs).  The FLUCs allow consideration of suburban or urban residential uses in the range of potential uses. The proposed density is consistent with the UF-3 and MU-C/R FLUCs.  Special approval is required for a gross density exceeding one dwelling unit per acre and net density (4.54 dwelling units per acre) exceeding three dwelling units per acre in the UF-3 and MU-C/R FLUCs.
• Special approval is also required for a project adjacent to a perennial stream (Mill Creek). 
• Planned development is the procedure necessary to acquire Special Approvals.
• The site is in the X and AE Flood Zone Category with Base Flood Elevations between 28.5’ and 32.0’ NAVD 1988 per FIRM Panels 12081C0331E, 12081C0333E and 12081C0334E. 
• The site is in Hurricane Evacuation Zone E.
• County water and sewer are proposed.
• Recreational amenities include an amenity center and pool(s) on 2.20± acres. 
• There are 7.42± acres of wetlands on-site. 0.49± acres will be impacted.  Along the east perimeter, the site is adjacent to a 30-foot and 50-foot wide wetland buffer.  
• In addition to the already approved access points, a new access point is proposed along White Eagle Boulevard, which is currently being constructed.  24-foot wide private internal roadways are proposed.
• The site plan shows five-foot wide sidewalks will be on both sides of the internal roadways because the site is within two miles of BD Gullett Elementary School.
• Staff has a concern that future residents may be impacted by noise from vehicles traveling along the adjacent roadways (44th Avenue East and White Eagle Boulevard).  To address any potential noise impacts from 44th Avenue East and White Eagle Boulevard, staff recommends the installation of a six-foot high solid decorative wall or fence with landscaping on the exterior side of the fence or enhanced landscaping in the buffer along 44th Avenue East and White Eagle Boulevard.
• Staff recommends approval with stipulations.      
• On February 11, 2016, by a vote of 7 – 0, the Planning Commission recommended approval.
• A summary of the public comment from the February 11, 2016 Planning Commission is in the staff report attached to this memo.
