FPL Abandoned Poles Agreement

Action Requested
Authorization for the Chairman of the Board of County Commissioners to sign Florida Power & Light (FPL) Abandoned Poles Hold Harmless and Indemnity Agreement.

Background Discussion

Currently FPL has power transmission lines running through Duette Preserve.  FPL is replacing the old wooden poles with concrete poles.  All of the wooden poles have nesting cavities occupied by various bird species.  The Southeastern American Kestrel is a listed threatened species by the State of Florida and utilizes many of these cavities for nesting.  The Natural Resources Department is dedicated to protecting the threatened species that reside within our preserves.  Manatee County and FPL will be in compliance with state law by maintaining these wooden poles and the cavities they contain on the preserve property.

This agreement is necessary for FPL to donate eight 70 ft poles to Manatee County.  The poles will be placed outside the FPL easement at a safe distance from the power lines and will not interfere with land management activities performed by the Natural Resources Department.

Duette Preserve is listed as a site on the Fish & Wildlife Conservation Commission's Great Florida Birding Trail. Ensuring that this species, along with other cavity nesting birds, are able to continue utilizing these wooden poles will allow bird watchers and nature enthusiasts to experience these species, as well as furthering department's goals to protect and support all listed rare, threatened, and endangered species on Duette Preserve.

Staff recommends signing this agreement.
