Action Requested
Adopt (and authorize execution of) the Manatee County Board of County Commissioners Flexible Benefit Plan amendment to add the $500 carry over provision and eliminate the grace period provision.

Background Discussion

Recent regulatory changes to IRS Section 125 now permits employers sponsoring a Flexible Benefit plan to allow their Health Care Flexible Spending Account participants to carry over up to $500 from year to year.

This will provide our employees some relief to the 'use it or lose it' rule by giving them the opportunity to use funds from the following plan year if they are unable to submit enough reimbursable expenses during their current plan year to exhaust their funds.

The 2-1/2 month 'grace period' we now accommodate, which allows participants to use 2-1/2 months during the following plan year to submit expenses, must be discontinued. An employer can only offer one option.

Employee Health Benefits believes the carry over option is more beneficial to the employees of Manatee County.
