Reduction of Code Enforcement Fines for Joseph Ewaskow (nka Jake and Saisunee Jacobson), Code Enforcement Case Number CE2011030637

Action Requested

Motion to reduce the fines for this case to $1,000.00 (as previously recommended by the Special Magistrate on February 24, 2016), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $242,900.00 for CE2011030637.
  2. Recording fees need to be collected, which total $40.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Code Enforcement Case CE2011030637. 39730 Carlton Rd, Parrish, FL. 34219 (PID #1601209) Below is a brief synopsis regarding this case:

  1. Violation: The house was constructed under permit #05100662 (2005' permit voided 3/22/11) and a garage/barn type structure was built without any permits and certificate of occupancy/completion.
  2. Notice of Violation issued 4/22/2011.
  3. Special Magistrate Hearing 1/25/2012.  Ordered to comply by 3/23/2012 for Section 512.1 or a $150.00 minimum fine and $100.00 per day fine would be imposed; and ordered to comply by 6/22/2012 for Section 513.1 or a $150.00 minimum fine and $100.00 per day fine would be imposed.
  4. Section 512.1 was complied 9/3/2015.
    Section 513.1 was complied 9/4/2015.
  5. Total fine $242,900.00 plus $40.00 recording fee.
  6. Property owner offered $1,000.00 plus $40.00 recording fee.
  7. Special Magistrate Mitigation Hearing 2/24/2016. The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $1,000.00 plus $40.00 recording fee.

This was a foreclosure property.

  1. 01/21/11 Property owner deceased.
  2. 03/30/12 Notice of Lis Pendens was filed.
  3. 03/03/14 Certificate of Title was awarded to the plaintiff
  4. 06/02/15 Deeded to the current owner

The new owner brought the property into compliance within approximately three (3) months after purchasing it and paid out approximately $13,600.00 dollars.
