Based upon the staff report, evidence presented, comments made at the Public Hearing, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, as conditioned herein, I move to ADOPT Manatee County Zoning Ordinance No. PDR-02-41(P)(R); amending and restating Ordinance No. PDR-02-41(Z)(P) with Stipulations 1 - 21, revising Stipulations 1 and 3 and adding Stipulation 22, as recommended by staff.

Background Discussion


  • The site, Palmetto Estates Subdivision, is at the northwest corner of the 21st Street East and Canal Road intersection at 1300 21st Street East (±55.84 acres).
  • On May 2, 2004, the Board of County Commissioners approved a  rezone of the subject  site from A-1 (Suburban Agriculture, 1 dwelling unit per acre) and RSF-4.5  (Residential Single-Family, 4.5 dwelling unit per acre) to PDR (Planned Development  Residential) and approval of a Preliminary Site Plan to allow 200 lots for  single-family detached homes.  The project is designated as an affordable housing  project with at least 25% of the project or 50 lots designated affordable out of the  200 lots.
  • The Final Site Plan was approved in 2005 and a Final Plat approved in 2007.  There  are approximately 33 homes constructed.  The property went into foreclosure and now has a new owner.
  • The current owner, Canal Road Investments, LLC, requests to revise two stipulations.  One stipulation pertaining to required vegetation within the perimeter buffers and  another stipulation requiring a tot lot.
  • The width of the buffers is not changing.  The applicant proposes a 6 ft.high PVC fence in lieu of a required hedge in the roadway buffers and a 6’ high PVC fence, in lieu of required canopy trees, in another buffer.
  • The applicant requests to remove the requirement for a tot lot and replace with an open space park area, while still providing parking, shade trees, and benches.
  • Staff has no objection to the request and recommends approval.
