Transportation Regional Incentive Program (TRIP) Agreement with the Florida Department of Transportation

Action Requested

Authorization by the Board of County Commissioners for the Chairperson to execute the Transportation Regional Incentive Program Agreement, CSFA No. 55.026, Financial Project No.: 437145-1-34-/54-01, with the Florida Department of Transportation.

Adoption by the Board of County Commissioners and authorization for the Chairperson to execute Resolution R-17-058.

Enabling/Regulating Authority

The State of Florida Department of Transportation has the authority, under Section 334.044, Florida Statues (F.S.), to enter into this agreement.

The Transportation Regional Incentive Program

Background Discussion
  • The project consists of the design and construction of intersection improvements on SR 684 (Cortez Rd.) and 43rd Street West.
  • Manatee County agrees to undertake the design and construction of the project in accordance with all applicable federal, state, and local statutes, rules, regulations, and standards.
  • Manatee County and the FDOT agree to share equitably the cost of the project.   Each share is 50% of the costs for project expenditures.
  • The estimated total cost of the project is $543,300.  The estimated cost share for both Manatee County and the FDOT is $271,600 each.
  • Time is of the essence to formally memorialize the agreement given the allocated funds will be removed by the  FDOT if the signed agreement is not submitted to the FDOT by the 9th of June 2017.
  • The CAO has reviewed this agreement and provided red-line edits that have been shared with the FDOT.  All substantive comments have been addressed.

Explanation of Other

Attached is the response from the County Attorney.

  • The FDOT has revised the document to incorporate certain revisions pertinent to this project per the CAO red-line edits. 
  • The agreement is a standard form used by the FDOT throughout the State of Florida, therefore requested style changes and other CAO red-line edits were rejected. 
  • The FDOT District 1 staff  informed County staff that they are not prepared to make any other changes to this FDOT form agreement. 
  • Failure to execute this agreement will result in the loss of $271,600.

Return two originals of the TRIP Agreement and one certified copy of  Resolution R-17-058 to Barbara Green for overnight transmittal to FDOT by June 9, 2017.
