Execution of Purchase Sale Agreement from CSX Transportation, Inc., for property located on 36th Avenue East, Ellenton, Florida

Action Requested
  • Execution of two (2) original Purchase Sale Agreements with CSX Transportation, Inc., for the purpose of the Ellenton Gillette Road Intersection Project (U.S. 301 at Ellenton Gillette Road) in the amount of $18,000.00.

Enabling/Regulating Authority
Chapters 125 and 127, Florida Statutes. Manatee County Comprehensive Plan Goal 5.1 addresses the safety and efficiency of forecasted vehicular demands.

Background Discussion
  • The Ellenton Gillette Road Intersection Improvement Project (U.S. 301 at Ellenton Gillette Road) was approved in the FY 2014-2018 CIP 381-6035161.
  • Parcel 9 is an unimproved rectangular parcel and abuts the westerly maintained right-of-way of Ellenton Gillette Road. The project requires a partial acquisition of 1,612 square feet.
  • On September 9, 2015, Appraiser Nicholas Chop, MAI, Florida Valuation Inc., determined the value of the area for acquisition at $14,550.00. There is no cost to cure, no damages, and no improvements.
  • Staff and CSX Transportation, Inc. (CSX) have reached a settlement of $18,000.00 and CSX will execute a quitclaim deed.
  • Subsequent to the issuance of the attached County Attorney's Office memorandum, additional negotiations took place. Ultimately, the parties arrived at the attached agreement which addresses some of the concerns originally identified by the County Attorney's Office. Any remaining concerns were deemed business decisions made by the Public Works Department.
  • Public Works and the Property Acquisition Division recommend approval of the negotiated Purchase Sale Agreement.  
  • Manatee County will be the first party to execute the Purchase Sale Agreement (PSA) since the deposit is due ten days after execution by CSX Transportation, Inc.
