Background Discussion

University Groves Development, LLC (the "Developer") owns or has developed certain real property located in unincorporated Manatee County, Florida, located north of University Parkway and generally between Shade Avenue and Tuttle Avenue. 

In 2006, Manatee County approved a revised preliminary site plan for University Groves Development, PDMU-06-16(P)(R) (the "Project"), and the project is substantially built out except for portions of Areas IV, V, and VI (the "Town Center").

As part of the Certificate Level of Service (CLOS) for the project, the County conditioned the approval of the installation of a traffic signal at Shade Avenue and University Parkway when warranted (the "Traffic Signal").  This construction shall complete the required public improvements, which includes construction of Broadway, turn lanes, deceleration lanes, and significant sanitary sewer improvements. This CLOS provision requires participation in the fair share of new signal at Shade Avenue and University Parkway when the intersection meets warrants. 

The developer is currently developing the property for mixed use purposes. 

Based on a June 2015 study, submitted for the development, staff agrees with the developer's analysis that finds the intersection meets warrants for signal installation.  The developer has requested that the County enter into an agreement with provisions that the developer construct and the County pay any amount in excess of the developer's share.  The County's share under the applicant-proposed terms is about thirty-one percent (31%) of the total costs.

The developer has submitted to the County the design, engineering, and permitting ("Plans"), and the County has approved the plans for construction.

The County's obligation to reimburse the developer shall not exceed the sum of one hundred sixty-five thousand, seven hundred ninety dollars ($165,790.00).

Manatee County and the developer desire to memorialize their agreement in writing by the execution of the Traffic Signal Participation Agreement for Manatee County Installation at Shade and University Parkway.
