Resolution 16-083 Extension to CLOS No. 05-101 for Greyhawk Landing West

Recommended Motion: 

To adopt Manatee County Resolution 16-083, extending the Certificate of Level of Service (CLOS) 05-101 for Greyhawk Landing West.

Background Discussion

• Applicant is requesting an extension to CLOS #05-101 for two years, which will give a new expiration date of 11/2/2018.

• Section 360.7 of the Manatee County Land Development Code allows the Board of County Commissioners to extend a CLOS up to two years, when the CLOS was originally issued for three years.

• The project is located north of SR 64 and east of 117th Street East at 12705 SR 64 East, Bradenton. 

• A preliminary site plan was approved on 11/3/2005 and most recently amended on 4/5/2012 by the Board of County Commissioners.  The final site plans have been approved administratively for all five phases of development.  The approved site plan allows for 501 single family residential dwelling units.  To date, 335 lots have received final plat approval with an additional 51 lots currently being reviewed by staff.  All final plats must be approved prior to the expiration of the CLOS.  The applicant is also seeking an extension to the preliminary site plan.

• The CLOS was originally issued on 11/3/2005 for 3 years.  The CLOS has been extended several times as follows:
One year with County Resolution 07-248 until 11/3/2009
Local Development Agreement until 11/3/2012
Two years with County Resolution 09-089 until 11/3/2014
Florida Statutes 252.363 (Tropical Storm’s Debby and Isaac) for one year and 121 days until 3/3/2016
Florida Statutes 252.363 (Tropical Storm Erika) for 60 days and 6 months until 11/2/2016

• Capacity has been reserved for solid waste, traffic circulation, potable water, sanitary sewer, and drainage.

• The Developer was required to participate in the cost of improvements for the SR 64 at Pope Road intersection and made a 2013 proportionate share payment toward future improvements at this location. The Developer was also required to dedicate right of way, design, engineer, permit and construct 117th Street East as a two lane urban road section.  The roadway has been constructed from SR 64 to the Rosemary Circle intersection. The remaining section from Rosemary Circle to 4th Avenue East will be constructed in Phase V-B.

• It has been determined that the applicant has made timely application per LDC Section 360.7.  The extension request was received on 10/22/2015 for an 11/2/2016 expiration.
