Private Engagement for the County Attorney.

Action Requested
Authorization for the County Attorney to serve in the capacity of an expert witness in the matter of Ronald Puleo v. Blucher Law Group, LLC, et al., Case No. 2011 CA 003787 NC, as currently pending in the Circuit Court in Sarasota County, Florida.

Enabling/Regulating Authority
Section 6 of the County Attorney Employment Agreement dated March 27, 2012.

Background Discussion
Some 8 to 10 months before becoming County Attorney and while engaged in the private practice of law, your County Attorney was approached by one of the litigants in the above-styled legal malpractice matter and asked to potentially serve as an expert witness.  Your County Attorney preliminarily agreed to do so.

The lawsuit then entered an extended period of dormancy, but is now active again.  The County Attorney was recently informed that his services were still needed and has again been asked to serve as a potential expert.  In light of his previous agreement to assist, the County Attorney feels a continuing obligation to see the matter through to conclusion.

The lawsuit is a private dispute and does not involve any government entity as a party.  The activity will be undertaken by the County Attorney strictly on his own time.  The County Attorney will be compensated for his efforts.

Outside engagements are authorized in the County Attorney Employment Agreement, albeit with the consent of the Board of County Commissioners.
