Execute Contract for Sale and Purchase for a Permanent Utilities Easement from BRHC, LLC, an active Florida Limited Liability Company, successor by merger with Barthomolew Real Estate Holding Corp., an inactive Florida Corporation, in the amount of $12,500, inclusive of attorney's fees, for the purpose of a waterline installation at 5524 14th Street West, Bradenton, Florida 34207.

Enabling/Regulating Authority

Chapters 125 and 127, Florida Statutes, Comprehensive Plan Goal 11.5-11.7, addresses the potable water system.

Chapters 73 and 74, Florida Statutes.

Background Discussion

The Suburban Waterline Project Phase 3 was approved in the FY 2008-2012 CIP.

The subject property is located at the northwest corner of 14th Street West and 56th Avenue West, Bradenton, Florida, having a physical address of 5524 14th Street West, Bradenton, Florida. The commercial site is improved with a Value Pawn retail store, fenced storage area, and separate sheds at the rear of the property.

The area of the easement is located at the southwest corner of the parent tract in an overgrown area west of the two sheds. The easement is delineated as 10 feet by 25 feet containing 250 square feet, which affects a 25 foot section of a 4 foot chain link fence that forms a westerly boundary of the property.

On February 18, 2013, R & W Enterprises appraised the area of the easement and improvements at $2,800. Through ongoing negotiations since March 2013 a final settlement was reached with the owner through their attorney for $12,500.00, which is inclusive of attorney fees totaling $3,500.00.

The negotiated contractual price of $9,700 is above the appraised value to avoid additional expert fees for attorneys, land planners, engineers and appraisers.

Two Manatee County Code Enforcement liens totaling $722.00 will also be satisfied with the proceeds from the closing.
