Background Discussion

Manatee County proposes to improve 44th Avenue East from 30th Street East to 45th Street East.  This project is a CIP-approved project.

The parent tract is located at 4511 44th Avenue East, Bradenton, on the north side of 44th Avenue East and is improved with a single-family residence and two detached garages.  Parcel 121 is a partial acquisition of land encompassing 11,024 sq. ft. and consists of part of an existing fence, driveway, landscape buffer, and other minor improvements.

Pre-suit negotiations with counsel for the property owners were unsuccessful, and on March 28, 2014, the County filed eminent domain proceedings.

Prior to the Order of Taking Hearing, the property owners agreed to stipulate to the taking, and they requested extended possession of Parcel 121 as a condition of the stipulated order.  After conferring with the Public Works Department, our office agreed to extended possession of the parcel until 12 noon on Friday, November 7, 2014, as the time period will not interfere with the County’s construction schedule of this project.

On June 3, 2014, the Court entered a Stipulated Order of Taking which permits Morris H. Griggs and Anginette Griggs extended possession of Parcel 121.

After discussions with County staff, the County Attorney’s Office recommends granting Morris H. Griggs and Anginette Griggs extended possession of Parcel 121 until 12 noon on Friday, November 7, 2014.
