I move to hold the second public hearing to adopt proposed Ordinance 17-30 on August 3, 2017 at 9:00 am or as soon thereafter as same may be heard (in lieu of after 5:00 pm) pursuant to Section 125.66(4)(b)1. Florida Statutes.

Background Discussion
  • As part of the LDCT-17-01/Ordinance 17-30, staff is proposed to amend Tables 4-1, Schedule of Uses in Agriculture and Residential Development, 4-2, Schedule of Uses in Non-Residential Districts, and Table 4-7 Schedule of Uses for PD Districts.
  • Per Section 125.66(4)(6)1. Florida Statutes, in order to adopt changes to the actual list of permitted, conditional, or prohibited uses within a zoning category, the Board of County Commissioners shall hold two advertised public hearings on the proposed ordinance. At least one of the two required public hearings shall be held after 5:00 p.m. on a weekday, unless the Board of County Commissioners, by a majority plus one vote (5 votes in favor), elects to hold the second hearing at another time of the day.
  • On May 11, 2017, by a vote of 6 - 0, the Planning Commission recommended approval of the proposed amendment to the Land Development Code, as described above. The first required public hearing, before the Board of County Commissioners is on this agenda, June 1, 2017.
  • Staff is requesting the Board of County Commissioners to hold the second required public hearing on August 3, 2017 during the regularly scheduled Land Use Meeting.
