First Amendment to Potable Water Agreement with Sarasota County Adding Two (2) Meter Locations

Action Requested
Authorization for Chairman to execute "First Amendment to Interlocal Agreement" with Sarasota County for provision of potable water.

Enabling/Regulating Authority
Section 125.01, Florida Statutes; Chapter 153, Florida Statutes; and Chapter 63-1598, Laws of Florida, as amended.

Background Discussion
Manatee County and Sarasota County entered into an Interlocal Agreement dated October 21, 2003, for the provision of potable water by Manatee County to Sarasota County. The agreement replaced a previous long-term supply agreement and established a phase-out schedule which terminated the provision of water to Sarasota County in 2025.

Per language in the 2003 agreement that requires additional water delivery locations be established with an amendment to the agreement, this 'First Amendment  to Interlocal Agreement' establishes two additional meter locations for provision of service. It does not change the previously agreed upon phase-out schedule for ether quantity or duration.

Schroeder Manatee Ranch wishes to develop property just south of University Parkway in Sarasota County to which Sarasota County cannot yet provide water and wastewater service. Sarasota County wishes to utilize potable water from the existing water supply agreement with Manatee County to serve this area. A separate agreement for temporary provision of wholesale wastewater service to the area is also being requested. These services will be provided to this area by Sarasota County when their facilities are available. The water agreement is set to terminate in 2025 and the proposed wastewater agreement will terminate in 10 years (2028) unless Sarasota County facilities are available earlier.
