Florida Impact Fee Act; Land Development Code Chapter 11 (Impact Fees) and Chapter 2 (definitions related to impact fees)
In April and May, the Board of County Commissioners held work sessions on impact fees. The Board provided general direction to:
1) bring forward housekeeping updates to the Land Development Code (LDC) based upon the Clerk's audit, clarify policies and move administrative details to the proposed Impact Fee Procedures Manual;
2) allow the expenditure of "old money" within cities; and
3) bring forward item to allow consideration of County impact fees to continue at 90% of the schedule in the 2015 Impact Fee study instead of increasing to 100% in April 2018, amending the LDC.
This agenda item is related to #1 above, specifically the adoption of the Impact Fee Procedures Manual.
This item considers Resolution 17-107, the Impact Fee Procedures Manual. Staff recommends moving administrative details regarding Independent Impact Analysis and Credits from the Land Development Code to the Procedures Manual. The Procedures Manual clarifies interpretations of the LDC and specifies
information for approval of credits. The Procedures Manual describes responsibilities of the County Impact Fee Administrator, including an annual review and report on fee collections, expenditures, fund balances, administrative changes and possible study updates. As specified in the Procedures Manual, the Financial Management Department will conduct quarterly internal audits of impact fee assessments.
On October 12, 2017, the Planning Commission found the Impact Fee Administrative Procedures Manual to be consistent with the Comprehensive Plan and in accordance with the Land Development Code recommending approval of Resolution 17-107.
November 2, 2017 was the first Board public hearing on this item.
This is the second of two public hearings.
