Background Discussion

Manatee County proposes to construct a potable water main crossing the Manatee River from Fort Hamer Road to Upper Manatee River Road.  This new water main crossing will provide Manatee County with a second water main supply line to North County.  This project is a CIP-approved project.

The parent tract is a vacant rural lot and is located on the east side of Fort Hamer Road and north of the Manatee River with a physical address of 1912 Fort Hamer Road, Parrish, Manatee County, Florida.  The area acquired is described as follows:  Parcel 803 is a 20-foot wide Permanent Utilities Easement of 7,048 sq. ft. of the parent tract, a strip take on the property frontage on Fort Hamer Road.  The improvements contained within the area to be acquired consist of perimeter barbed-wire fencing.

The County's appraiser concluded to a total value of $2,950 based on a value of the land acquired at $2,500; $100 for improvements within the easement area; and $350 net cost to cure consisting of repairing the entry and exit points for the pipeline.

As a result of negotiations, a settlement was reached in the amount of $11,000 for the acquisition of Parcel 803 which includes the approximate costs for line and connection fees associated with establishing a residential, single-family account with Manatee County for water service and installation of a water meter on the landowners' property after the completion of the Project's water line.

Pursuant to Sections 73.091 and 73.092, Florida Statutes, this settlement contemplates the payment of additional funds for attorney's fees and costs, inclusive of both monetary and non-monetary benefits, and expert costs in the total amount of $2,275, resulting in a total aggregate purchase price of $13,275.

This settlement takes into account the relative strengths and weaknesses of this matter and the estimated costs associated with proceeding with litigation as well as the value of the property acquired.

The Contract for Sale and Purchase for a Permanent Easement and Addendum is hereby submitted to the Board of County Commissioners for approval and execution.
