Action Requested


Based upon the staff report, evidence presented, comments made at the Public Hearing, the action of the Planning Commission, and finding the request to be CONSISTENT with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, I move to ADOPT Manatee County Zoning Ordinance No. Z-15-03, as recommended by the Planning Commission.

Background Discussion

• Allison-Gause, Inc., agent for the owner, is requesting approval of a straight rezone from A-1 (Suburban Agriculture), RSF-4.5, and PDR (Planned Development Residential w/no associated site plan) to RSF-4.5 (Residential, Single Family minimum 7,000 square foot lots) for a 58.02-acre property (MC-1) generally on the east and west sides of 28th Avenue East and South of 61st Street East (Palm View Road) currently known as the Palm View Golf Course, Palmetto.

• The maximum number of dwelling units is approximately 261 units.  The FLUC is RES-6 (Residential – 6 dwelling units/acre).

• The requested RSF-4.5 zoning is consistent with the existing development pattern and zoning of nearby properties and is a logical extension of the residential development pattern.

• The RES-6 FLUC provides for a maximum gross residential density of 4.5 du/gross acre unless a Special Approval is applied for (which requires a rezone to Planned Development).  Additionally, the RSF-4.5 zoning provides for a minimum lot size of (7,000 square feet with 70-feet of frontage) and a maximum density of 4.5 du/ac. 

• This is a straight rezone request, there are no Special or Specific Approvals nor Staff Stipulations.    

• On July 9, 2015, by a vote of 6 – 1, the Planning Commission recommended approval. Mr. Bower voted nay stating the rezoning makes sense but school concurrency continues to be an issue moving forward without serious discussion and change is poor planning and he can’t recommend this to the Board of County Commissioners. A summary of public comments heard at the July 9, 2015 Planning Commission public hearing are in the staff report attached to this memo.
