FPL Easement Agreement for Sewer Forcemain at Amazon

Action Requested
Authorization for Chairman to execute the Florida Power and Light Easement Agreement with Manatee County Government for the sewer force main at Amazon.

Background Discussion

Developer holds legal title to a 1203.83± acre parcel of real property located in Manatee County and generally bounded by Moccasin Wallow Road to the south, US 301 to the east, vacant property to the north, and vacant property to the west (the "Project Site"). the complete legal description for which is attached hereto as Exhibit "A";

Applicant has applied for zoning and preliminary site plan approval from Manatee County pursuant to Application No. PDMU 13-37(Z)(P) to rezone the Project Site to the Planned Development Mixed Use (PDMU) Zoning District and to allow 1,999 residential units, and 60,000 square feet of non-residential uses to be constructed on the Project Site (the "Project");

The Developer desires to connect the Project to the County's Wastewater collection/conveyance system for the benefit of the Project.  Pursuant to the  County's request, the Utility Improvements depicted in the Scope of Work will exceed the capacity required by the proposed project. 

The proposed sewer forcemain will cross the Florida Power and light (FPL) Railroad Right-of -Way, and will benefit the Developer and the Manatee County Utilities System.  The attached FPL Railroad Easement Agreements for Utilities allows the construction of the wastewater collection/conveyance system to move forward.  The proposed easement and its sewer forcemain will become Manatee  County's infrastructure and asset upon installation.  Therefore by executing this agreement the County agrees to acquire the easement for the Utility Improvements and acknowledges that the Developer shall design, engineer, permit, and construct the Utility Improvements within the easement in accordance with the Scope of Work described in the existing executed LDA with Developer.

In general,a ll utilities crossing and/or accessing FPL or CSX Railroads Right-of-Way require a liability insurance policy in the amount of $3,000,000 with FPL shown as Loss-Payee on the policy.  The annual estimated premium for this policy is $800.00.
