Reduction of Code Enforcement Fines for US Bank National Association, Code Enforcement Case Number CE2015070401 - 1108 64th St NW, Bradenton

Action Requested

Motion to reduce the fines for this case to $10,000.00 (as previously recommended by the Special Magistrate on July 26, 2017), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $133,500.00 for CE2015070401.
  2. Recording fees need to be collected, which total $120.00.
  3. Building and Development Services Department Director is authorized to sign satisfactions of liens if the reduced fines are paid.

Background Discussion

Florida Owners Store, LLC, the current property owners, purchased the property on 5/28/2017  and are seeking a fine reduction. The property owners have brought the property into compliance and have made numerous repairs and are currently renovating the property. 

  1. Violations:   Fence, walls, roof, flashing and swimming pool screen cage in disrepair and the swimming pool not maintained in a clean and sanitary condition and not working.
  2. Notice of Violation issued 7/21/2015.
  3. Special Magistrate Hearing was held on 9/23/2015 - Ordered to comply by 10/23/2015 or a fine of $75.00 per day per section (six) would be imposed.
  4. Compliance date was 3/2/2017.
  5.  Fines for the case total $133,500.00 plus $120.00 recording fees to settle the case.
  6. Special Magistrate Mitigation hearing was held on 7/26/2017.  The Magistrate determined that justification exists to reduce the total fine amount and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount which totals $133,500.00 to $10,000.00 plus $120.00 recording fees to settle the case.  Staff recommends approval.
