  • Accept and Execute Required Improvements Agreement and Temporary Construction Easement for Private Improvements – Final Lift of Asphalt with Lennar Homes, LLC; and
  • Accept Letter of Credit No. FGAC-05333, Amendment No. 10, in the Amount of $60,942.30.

Background Discussion

The developer has requested an extension on the final lift of asphalt for this project, which will be privately maintained.  The developer has started building the infrastructure for the development and is requesting the extension in order to complete those required improvements without marring the roadway.  This project has had a substantial amount of the final lift installed, and the Developer is therefore also requesting to reduce the current agreement in the amount of $296,567.78 to the reduced amount of $60,942.30.  The Public Works Infrastructure Division conducted an inspection of the installed final lift on June 26, 2014, and is in agreement with the developer's request.  The Public Works Department has reviewed the request and is in agreement with the developer's reduced dollar amount and extension.

This agenda item is to extend the agreement and security to ensure the developer is not in default with the agreement previously provided.  The developer has been notified of Resolution R-14-02 and has chosen to reduce the original 200% plus 3% administrative fee to the approved 130%.
