Action Requested

Authorize the County Administrator or his designee to execute Change Order # 2 decreasing the Agreement amount by ($96,453.05) from $2,264,246.28 to $2,167,793.23 and adding forty three (43) calendar days to the Agreement.

Background Discussion

Change Order # 2 adjusts the final quantities to reflect materials and labor actually used during construction, provides for reimbursement due to retesting, adding 43 calendar days to the Agreement thereby extending the date of substantial completion to June 23, 2012, and assesses liquidated damages.

The contractor did not meet the agreed upon date of June 23, 2012, for substantial completion resulting in the assessment of liquidated damages in the amount of  $19,516.00 (17 days x $1,148 per day).

The contractor is required to reimburse the County the costs incurred to re-test areas that failed to meet standards when first tested. The cost of such re-testing totals $3,069.75.

Change Order # 1 added 13 calendar days and adjusted the completion date to May 12, 2012, with no monetary increase.

ACA # 2 increased the Agreement cost by $34,715.94, added 19 days and extended the Agreement completion date to April 29, 2012.

ACA# 1 increased the Agreement cost by $5,102.73, added 11 days and extended the Agreement completion date to April 9, 2012.

On 10/18/2011 the BCC executed an Agreement with McLeod Land Services, Inc., in the amount of $2,224,427.61 for construction of the El Conquistador Parkway Extension Phase IIA.
