Background Discussion
  • The applicants, Matthew J. Stull, Alicia M. Stull, and Mary J. Reeder, are requesting to vacate a portion of platted drainage easements for property located at 6232 28th Avenue East, Bradenton.
  • The Hidden Meadows plat was recorded in the Manatee County Public Records on December 20, 1984, in Plat Book 22, Pages 60-62.
  • The applicants have requested a vacation of the easements due to the air conditioning pad, fence, and private well encroaching upon the easement area.
  • Jurisdictional reviews by appropriate County departments and private utility companies serving the area to be vacated have been notified of the intention to file a vacation and have no objection.
  • A Pre-Application meeting with Tom Gerstenberger, Stormwater Engineering Division Manager, former Field Maintenance Division Manager, Danny Smith, and Matthew J. Stull and Alicia M. Stull was held prior to the vacation being filed with the Property Acquisition Division. Given the no objection from Danny Smith and Tom Gerstenberger, staff has no concern with the future drainage, access, and maintenance and/or right of convenient access for surrounding property owners and the subdivision.
  • The vacation application complies with the technical requirements of the Manatee County Land Development Code and pertinent Florida Statutes.
  • All expenses associated with the subject vacation will be paid by the applicants.
  • Manatee County's application filing fee of $200 has been paid.

Alicia M. Stull is employed with the County Attorney's Office (CAO). The opinion was referred to outside counsel (Regina A. Kardash, Esquire, Persson & Cohen, P.A.) to avoid any conflicts of interest and maintain impartiality in the rendering of the legal opinion.
