  • Execution of Contract for Sale and Purchase with Robert McLean and Heather McLean for the purpose of the 44th Avenue East Road Improvement Project from 45th Street East to 44th Avenue Plaza East.

Background Discussion
  • The 44th Avenue East Road Improvement Project from 45th Street East to 44th Avenue Plaza East was approved in FY 2014 (Project Number 6086960).
  • This agenda item includes the acquisition of Parcels 131-134, including the homestead parcel, all owned by Robert and Heather McLean. This partial acquisition is 37,662 square feet.
  • On March 16, 2017, Appraiser Nick Chop, MAI, of Florida Valuation, determined the value of the area for acquisition at $168,550.00; land and improvements acquired, $118,000.00; cost to cure, $50,550.00.
  • Independence Acquisition and Appraisal, LLC, was assigned to handle and negotiate with the owner's attorney to reach an agreement for the land.
  • The owners retained attorney Gregory S. Rix of Moore Bowman & Rix, P.A.
  • A global settlement of $500,000.00 was approved by Public Works, eliminating additional costs for litigation fees or expert fees associated with this agreement.
  • Manatee County, as the condemning authority, is required to pay a landowner's attorney fees and reasonable expert costs in eminent domain proceedings.
