Background Discussion

On March 30, 1993, the Board of County Commissioners (the "Board") adopted Ordinance No. 93-22, which was codified as Article IV of Chapter 2-17 of the Manatee County Code of Laws and which implemented the provisions of Part VII of Chapter 420, Florida Statutes.  On August 26, 1993, the Board adopted Ordinance No. 93-44, adopting minor textual amendments to Ordinance No. 93-22.  In the time since the adoption of the 1993 ordinances, the Florida legislature enacted numerous amendments to Part VII of Chapter 420, Florida Statutes.  Additionally, the Florida Housing Finance Corporation has promulgated administrative rules for the implementation of the statutory provisions.

On April 22, 2008, Ordinance No. 08-44 was adopted by the Board to ensure the ordinance conforms to the County's Code of Ordinances, to that amended statute, and those administrative regulations.

The William E. Sadowski Act created the State Housing Initiative Partnership (SHIP) program for the purpose of providing a dedicated funding source to local governments as an incentive for local housing partnerships to expand and preserve affordable housing, including expansion of the affordable housing element of the local government comprehensive plan.

Pursuant to 420.9075(1)(a), each County participating in the SHIP program shall develop and implement a Local Housing Assistance Plan (LHAP) created to make affordable residential units available to persons of very low income, low income, or moderate income and to persons who have special housing needs, including but not limited to, homeless people, the elderly, migrant farmworkers, and persons with disabilities.  Counties or eligible municipalities may include strategies to assist persons and households having annual incomes of not more than 140 percent of area median income.  The intent of the plan is to increase the availability of affordable residential units by combining local resources and cost saving measures into a local housing partnership and using private and public funds to reduce the cost of housing.

Administrative Rule 67-37-005 requires the Board to adopt a resolution consistent with Ordinance 08-44 implementing the County's Local Housing Assistance Plan prior to transmittal of the plan to Florida Housing Finance Corporation (FHFC) for review and approval for receipt of funding.

During the year, public input was received through Affordable Housing surveys, meetings with housing advocates, and meetings with Lenders, Realtors, and Builders relative to the needs of the community and housing concerns.

On March 13, 2018, Redevelopment and Economic Opportunity Department staff held a work session with the Board to review the program guidelines and establish priorities for the new three-year plan.  The Board supported continuation of the existing housing strategies (owner-occupied rehabilitation, demolition/reconstruction, purchase assistance, disaster repair/mitigation, and rental development), incorporation of new Affordable Housing LDC incentives, and to continue to look at avenues to further encourage the development of affordable housing.

Based on comments and recommendations received, staff has developed Manatee County's FY 2018-2021 Local Housing Assistance Plan.

The Board's adoption of Resolution R-18-059 and execution of the Certification page to FHFC is required prior to transmittal of the Local Housing Assistance Plan to the State for review and approval by the May 2, 2018, deadline.

Upon FHFC review and approval of the Local Housing Assistance Plan, Manatee County will be eligible to receive funds for implementation of the SHIP program activities effective July 1, 2018.
