Statute 125.01 authorizes the County to exercise home rule powers for the health, safety, and welfare of the general public.

Background Discussion
The CARES Act, section 601(d) of the U.S. Social Security Act, created the Coronavirus Relief Fund (CRF) and provided Florida with $8,328,221,072; of which, 55% was allocated to the State of Florida and 45% was allocated to counties, including $17,500,000 that has been allocated to the COUNTY pursuant to a CARES Act Funding Agreement (“Funding Agreement”) between the COUNTY and the Florida Division of Emergency Management.

Pursuant to the Funding Agreement, CARES Act funds allocated to the County may be used for, among other things, protecting the health and wellbeing of residents by ensuring adherence to Federal and State COVID-19 Orders and CDC Guidelines; and assisting individual households recover from the effects to COVID-19 by providing economic, social, medical, and educational support to individuals and families through CARES Act funds issued by the COUNTY in accordance with the CARES Act, the Funding Agreement and US Treasury Guidance.

On July 28, 2020 the Board of County Commissioners adopted Resolution R-20-115 which provided for approval of the ManateeCARES Housing Assistance Program (HAP) Round 2 guidelines, which outline eligibility requirements, eligible use of funds, and documentation required for the program. The purpose of the HAP is to provide funds to renters and homeowners residing in Manatee County and its municipalities who are delinquent on rent or mortgage due to the impact of the COVID-19 pandemic. Funds are provided as a grant for delinquent rent and mortgage payments for approved applicants.

HAP Round 2 guidelines originally envisioned providing assistance at 3 months of arrears. Since the guidelines were approved on July 28th and the HAP Round 2 application closed on August 7, 2020, additional time consideration is needed given the continuing state of emergency.
  • In review of applications for assistance we are seeing 6 months of arrears that is needed with many applicants still unemployed.
  • The eviction moratorium has been extended through December 2020.
  • The State of Emergency has been extended.
  • HAP Round 3 Program Guidelines (using Florida Housing Finance Corporation allocation) were approved with an assistance award of up to $10,000.
