Based on evidence presented and finding the request to be consistent with the Manatee County Comprehensive Plan and the Manatee County Land Development Code, I move to approve and authorize execution of LDA-13-02(R3), Amended and Restated Local Development Agreement with North Manatee Investment, LLC, SFTEN, LLC, NPL Unit 2, LLC, and Parrish Holdings, LLC, for Villages of Amazon South.
Manatee County Comprehensive Plan
The Villages of Amazon South is approximately 1,032.23 acres located as 12420 US 301 North, Parrish, in the northwest quadrant of the Moccasin Wallow Road and US 301 intersection.
The Villages of Amazon South site was rezoned to Planned Development Mixed Use (PDMU) on September 4, 2014 (PDMU-13-37[Z][P]) for a larger parcel, with the approval of a Preliminary Site Plan (PSP) for 1,999 residential units and 40,000 square feet of commercial and 20,000 square feet of office space. The County Commission executed related Local Development Agreement (LDA-13-02) in November 2014 with minor amendments in 2016 and 2017.
In 2019, the County approved an updated site plan (PDMU-18-06(G)). The approved plan reflects the same amount of development but with a revised boundary that is about 170 acres smaller than the original Amazon approval. The LDA for the prior site plan addressed matters related to wastewater connections, offsite traffic impact mitigation, construction of a portion of Ft. Hamer Road, and a Certificate of Level of Service Compliance (CLOS) extension. At the time the agreement was drafted, there were several provisions related to the phased construction of Fort Hamer Road and language written in anticipation of upcoming amendments to the Wastewater Facility Investment Fee System related to line capacity. Development of the project has commenced, and many of these issues are clearer now. Another subject of the agreement was FF Road. The planned thoroughfare FF Road traversed a portion of the project at its northeast corner. FF Road is now planned to lie wholly offsite, and provisions related to FF Road have been removed in the draft agreement.
Therefore, and broadly summarized, the amended and restated agreement is a streamlined version of the original agreement that acknowledges the new development boundary, removes FF Road provisions, and simplifies language related to Fort Hamer Road, utilities, and timing of activities.
This is the second of two required public hearings. On September 15, 2020, this public hearing was continued to September 29, 2020, at the request of the applicant.

William Clague, Chief Assistant County Attorney, reviewed the agreement under CAO Matter No. 2019-0276 and participated in coordination meetings related to the agreement. The agreement presented for consideration incorporates the recommended changes provided by the County Attorney's Office.
