Background Discussion
  • The Applicant, Kathleen A. Dupont and Joseph A. Pontes Jr., are requesting a vacation of a 50-foot right-of-way within the Wellons Ranch Estates No.1 Plat.
  • At the August 20, 2019 public hearing, the Board voted on a motion to continue the public hearing until October 8, 2019. The motion passed 7-0. At the request of the Board, a survey of the area that is the subject of this agenda item and proposed vacation is now included with the agenda item.
  • The area sought to be vacated is 5,600 square feet and unimproved. The area abuts 8306 25th Street East in Parrish.
  • Jurisdictional reviews were sent to the appropriate Manatee County Departments and private reviewing entities. One conditional objection was noted from Todd Boyle, Survey Division Manager.
  • Todd Boyle responded without objection relative to the matters of survey, but indicated he would object to the vacation if either neighbor to the west or the neighbor to the north of the proposed vacated area objected to the vacation.
  • The neighbor to the west opposes the vacation and intends to voice his opinion at the public hearing.
  • The Property Management Department Director recommends approval of the proposed vacation that is the subject of this agenda regardless of the objection from Todd Boyle.
  • The vacation application complies with the technical requirements of the Manatee County Land Development Code and pertinent Florida Statutes.
  • All expenses associated with the subject vacation will be paid by the Applicant.
  • Manatee County's application filing fee of $200 has been paid.
