Reduction of Code Enforcement Fines for Tyrone Johnson, CE2016090096

Action Requested
Motion to reduce the fines for this case to $1,200.00 plus $28.50 recording fees, as previously recommended by the Special Magistrate on September 23, 2020, subject to the following conditions:
  1. The reduced fine shall be paid within 90 days or will revert to the original fine amount of $15,600.00.
  2. Recording fees shall be paid which total $28.50.
  3. Building and Development Services Department Director is authorized to sign Satisfaction of Lien if the reduced fine is paid.

Background Discussion
The owner, Tyrone Johnson, was cited for having an accessory use without a primary use (dump trucks, trailers and personal vehicles stored on his vacant parcel).  Mr. Johnson had started the process of rezoning this property on November 27, 2017, but it was never completed. Mr. Johnson indicated that he does not have the financial resources to pay the full amount as he has endured personal hardships.  Mr. Johnson is respectfully requesting that the fine be reduced.

Violation:  510(A) of the Land Development Code

  1. Notice of Violation was issued on September 8, 2016.
  2. The initial Special Magistrate Hearing was held June 27, 2018.  The respondent was ordered to come into compliance on or before August 17, 2018.
  3. A request for extension was heard in front of The Special Magistrate on October 24, 2018.  The property owner was granted an extension of time and was ordered to comply on or before February 22, 2019 or a minimum fine of $50.00 per day to a maximum amount of $20,000.00 would be imposed.
  4. Complied:  December 31, 2019.
  5. The Special Magistrate Mitigation Hearing was held September 23, 2020.  The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $1,200.00 plus $28.50 recording fees.  Staff supports this recommendation.
