Background Discussion

The owner, It Takes A Village Therapy, LLC, was cited for installing a new front door and beginning to replace the roof without the required Building Permits.  After Code Enforcement notified Kimberly Lane (Registered Agent and owner) of the violations, she made good faith efforts to obtain the required permits.  Ms. Lane indicated that retaining a contractor proved to be difficult, but eventually succeeded and a contractor was able to obtain the required permits. Ms. Lane respectfully requests that the fine be mitigated.

Violation:  Section 310.3 of the Land Development Code

  1. Notice of Violation was issued on July 31, 2018.
  2. The Special Magistrate Hearing was held on September 26, 2018.  The property owner was ordered to comply on or before October 19, 2018 or a fine of $50.00 per day to a maximum of $20,000.00 would be imposed for each day the property remained in violation.
  3. Complied:  March 17, 2020.
  4. The Special Magistrate Mitigation Hearing was held on September 23, 2020.  The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $2,028.50 to settle this case.  Staff supports this recommendation.
