Reduction of Code Enforcement Fines for William J Farrell, CE2011090439

Action Requested
Motion to reduce the fines for this case to $1,257.00 plus $20.00 recording fees, as previously recommended by the Special Magistrate on September 23, 2020, subject to the following conditions:
  1. The reduced fine shall be paid within 90 days or will revert to the original fine amount of $12,570.00.
  2. Recording fees shall be paid which total $20.00.
  3. Building and Development Services Department Director is authorized to sign Satisfaction of Lien if the reduced fine is paid.

Background Discussion

The previous owner, William J Farrell, was cited for having an unsecured swimming pool (screens missing from the cage). Mr. Farrell experienced financial hardships and walked away from the property. Mr. Farrell attempted to surrender and short sale the property, but was unable to do so. Mr. Farrell, after learning of the ordinance violations from Code Enforcement, abated the violations. Unfortunately, he did not comply until approximately seven months after the Magistrates-ordered compliance date.  Mr. Farrell is respectfully requesting that the fine be reduced.

Violation:  Section 703. Property Maintenance Standards


  1. Notice of Violation was issued on September 22, 2011.
  2. The Special Magistrate Hearing was held November 23, 2011.  The property owner was ordered to comply on or before December 23, 2011 or a minimum fine of $150 plus $100 per day would be imposed for Section 703.
  3. Complied:  April 26, 2012.
  4. The Special Magistrate Mitigation Hearing was held on September 23, 2020.  The Magistrate determined that justification exists to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount to $1,277.00 to settle this case.  Staff supports this recommendation.
