ADOPT Resolution R-15-150.

Enabling/Regulating Authority
  • Manatee County Land Development Code Chapter 9, Section 911.3, Public Hearing requirements for Vacation of Streets, Road, and other Appropriate Property.
  • Florida Statutes Sections 336.09 and 336.10 et seq., Closing and Abandonment of Roads.

Background Discussion
  • The applicant, Occidental Steel Industries, Inc., is requesting vacation of platted unimproved right-of-way at 12205-12257 US 41 North, Palmetto, Florida.
  • The right-of-way bisects the property owned by Occidental Steel Industries Inc., and is not used or constructed.  The right-of-way runs East and West between the two parcels owned by the applicant.  The vacation would eliminate a right-of-way that serves no useful purpose for the public or any adjoining property.
  • Jurisdictional reviews by appropriate county departments and utility companies serving the location to be vacated have been notified of the intention to file a vacation and have no objection.
  • The vacation complies with the technical requirements of the Manatee County Land Development Code and pertinent Florida Statutes. 
  • All expenses associated with the subject vacation will be paid by the applicant.
  • Manatee County's application fee of $800 has been paid.
