Action Requested

Motion to reduce the fines for case number CE2015070669 totaling $26,700.00 to $2,000.00 (as previously recommended by the Special Magistrate on September 28, 2016), subject to the following conditions:

  1. The reduced fines shall be paid within 90 days or will revert back to the original fine amount of $26,700.00.
  2. Recording fees need to be collected, which total $40.00.
  3. Building and Development Services Department Director is authorized to sign satisfaction of liens if reduced fine is paid.

Background Discussion

This property was the subject of a bankruptcy and foreclosure action that started in 2013 and lasted until 2016. Federal National Mortgage Association obtained title on August 19, 2016. The property was maintained with the exception of the pool.

Below is a brief synopsis regarding the case history:

  1. Violation: Swimming pool was not in working order and free of debris and pollutants.
  2. Notice of Violations was issued 8/16/2015.
  3. Special Magistrate Hearing was held on 9/23/2015 and was found in violation of sections 2-9-107(c)(1) and 2-9-107(c)(2).  Property owner was ordered to comply on both sections of the code or a $75.00 per day fine per section of the code would be imposed.
  4. Complied:  The property was brought into compliance on 4/19/2016. The number of days this property was in violation was 178.
  5. Fines for this case total $26,700.00 plus $40.00 recording fee.
  6. Property owner offered a total of $2,000.00 plus $40.00 recording fees to settle this case.
  7. Special Magistrate Mitigation hearing was held on September 28, 2016.  The Magistrate determined that justification exists to reduce the total fine amounts and to forward the request to the Board of County Commissioners with a recommendation to reduce the fine amount totaling $26,700.00 to $2,000.00 plus the $40.00 recording fee to settle this case. 
  8. Staff supports the request for reduction from the applicant and the recommendation of the Special Magistrate.
